Welcome to Luna Photography! By accessing or using our services, you agree to comply with and be bound by the following terms and conditions. If you do not agree with these terms, please do not use our website or services.
- Services Provided
Luna Photography offers professional photography services, including but not limited to portrait sessions, maternity photography, baby photography, event photography, wedding photography, food photography, engagement photography, corporate photography, etc.
- Booking and Payments
- Booking: To secure a booking, clients must complete a booking form and make an initial deposit or full payment, as required for the service.
- Payments: All payments are due in South African Rand (ZAR) and can be made via [accepted payment methods, such as EFT, credit card, etc.]. A non-refundable deposit of [amount] is required to confirm the booking. The balance of the payment is due on the day of the shoot or as specified in your contract.
- Refunds and Cancellations:
- Cancellations made more than two weeks in advance will receive a refund of the deposit amount, less any administrative fees.
- Cancellations made less than two weeks prior to the scheduled shoot are non-refundable, and the deposit will not be refunded. For emergencies, we may work with clients to reschedule or provide credit for future services.
- Intellectual Property and Copyright
- All photographs produced by Luna Photography are the intellectual property of Luna Photography and are protected by copyright under the South African Copyright Act (No. 98 of 1978).
- Clients are granted a non-exclusive, non-transferable license to use the images for personal, non-commercial purposes only, unless otherwise agreed in writing.
- Clients may not reproduce, distribute, sell, or use the images commercially without express written permission from Luna Photography.
- Any form of manipulation or alteration of the images (such as editing or creating derivative works) is prohibited unless authorized by Luna Photography.
- Image Usage and Marketing
- For Marketing: By booking a session with Luna Photography, you consent to the use of your images for promotional purposes, including but not limited to social media, website, and advertising. If you do not want your images used for such purposes, you must notify us in writing at least one week before the session.
- Editing Rights: Luna Photography reserves the right to edit or retouch images at its discretion, including adjustments to lighting, color, and composition.
- Privacy Policy and POPIA Compliance
In compliance with the Protection of Personal Information Act (POPIA), Luna Photography respects your privacy. We collect personal data such as your name, contact details, and payment information only for the purposes of providing photography services and related communications. Your personal information will not be shared with third parties without your consent unless required by law.

- Client Responsibilities
- Clients are responsible for ensuring they arrive on time for their scheduled photography session.
- Clients should inform us of any special requests, allergies, or medical conditions that may affect the session.
- It is the client’s responsibility to obtain the necessary permissions for photography at certain locations or involving third parties (e.g., event venues, guests, etc.).
- Limitation of Liability
- Luna Photography will not be held liable for any indirect, incidental, special, or consequential damages, or for any loss of data or profits arising from your use of our services.
- In the event of unforeseen circumstances (e.g., illness or equipment malfunction), we will work with the client to reschedule the session or offer a partial refund based on the specific situation.
- We are not responsible for third-party services (e.g., venue or vendor issues) that may affect the outcome of the session.
- Force Majeure
Neither party will be held liable for failure to perform their obligations if such failure is caused by circumstances beyond their control, such as natural disasters, strikes, or pandemics. In such cases, we will attempt to reschedule the session at the earliest opportunity or offer a refund or credit at our discretion.
- Governing Law
These terms and conditions are governed by the laws of the Republic of South Africa. Any disputes that cannot be resolved amicably will be subject to the exclusive jurisdiction of the courts in Cape Town South Africa.
- Amendments
Luna Photography reserves the right to update or modify these terms and conditions at any time. Any changes will be posted on this page with the updated effective date. Clients are responsible for reviewing these terms periodically to stay informed of any changes.
